1. Agreement to Terms

Welcome to GetScreened.in ("Platform," "Service," "we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Kakbhushindi AI Labs (KBAILabs), governing your access to and use of the GetScreened.in platform.

By accessing or using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our services.

These Terms include provisions that limit our liability and require individual arbitration for dispute resolution. Please review them carefully.

2. Eligibility and Account Registration

2.1 Eligibility Requirements

To use our Platform, you must:

Be at least 18 years of age
Have the legal capacity to enter into binding contracts
Not be prohibited from using the service under applicable laws
Provide accurate and complete registration information
Maintain the security of your account credentials

2.2 Account Types

Company Accounts:

Must be registered by authorized company representatives
Require valid business information and contact details
Subject to subscription fees and payment terms
Grant access to recruitment and screening features

Candidate Accounts:

Free registration for individual candidates
Access to practice interviews and skill assessments
Profile creation and GetScreenedURL generation
Subject to fair use policies

2.3 Account Security

You are responsible for:

Maintaining the confidentiality of your login credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access
Not sharing your account with others
Using strong passwords and enabling two-factor authentication

3. Description of Services

3.1 Platform Features

GetScreened.in provides the following services:

AI Voice Bot Interviews: Automated interview screening available 24/7
Video Recording: Recording and analysis of candidate interviews
Sentiment Analysis: AI-powered emotion and communication pattern detection
Skills Assessment: Technical and soft skills evaluation
GetScreenGPT: Custom job description analytics and candidate matching
Practice Interviews: Unlimited practice sessions for candidates
GetScreenedURL: Shareable candidate profile links
Analytics Dashboard: Comprehensive recruitment insights for companies

3.2 Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access
Scheduled maintenance will be announced in advance when possible
Emergency maintenance may occur without prior notice
We reserve the right to modify or discontinue features with notice

3.3 AI Service Disclaimer

Important AI Limitations:

AI assessments are tools to assist, not replace, human decision-making
Results should be used as one factor in comprehensive evaluation processes
AI models may have inherent biases despite our efforts to minimize them
Users are responsible for ensuring compliance with employment laws
We do not guarantee hiring outcomes or candidate success

4. User Responsibilities and Conduct

4.1 Acceptable Use

You agree to:

Use the Platform only for lawful purposes
Provide accurate, truthful information
Comply with all applicable employment and anti-discrimination laws
Respect the intellectual property rights of others
Maintain professional and respectful communication

4.2 Prohibited Conduct

You must NOT:

Misrepresent your identity, qualifications, or company affiliation
Use automated bots or scripts to access the Platform (except our official APIs)
Attempt to reverse engineer, decompile, or hack our systems
Share, sell, or distribute interview content without authorization
Upload malicious code, viruses, or harmful content
Scrape or collect data from the Platform without permission
Use the service for discriminatory purposes
Interfere with other users' access to the Platform
Violate any applicable laws or regulations

4.3 Content Standards

All content you submit must:

Be accurate and not misleading
Not infringe on intellectual property rights
Not contain offensive, discriminatory, or illegal content
Not contain personal data of others without consent
Comply with professional standards

5. Payment Terms and Subscriptions

5.1 Company Subscriptions

Pricing: Subscription fees are displayed on our pricing page and subject to change with 30 days notice
Billing: Recurring charges based on selected plan (monthly/annual)
Payment Methods: Credit card, debit card, or approved payment methods
Taxes: Prices exclude applicable taxes, which will be added at checkout
Auto-Renewal: Subscriptions automatically renew unless cancelled

5.2 Cancellation and Refunds

Cancellation: Cancel anytime through your account settings
Effect: Service continues until end of current billing period
Refunds: Generally not provided for partial billing periods
30-Day Money-Back: Available for first-time subscribers (terms apply)
Downgrade: Changes take effect at next billing cycle

5.3 Free Tier for Candidates

Basic candidate features are free of charge
Subject to fair use policies and usage limits
Premium features may require payment in the future
We reserve the right to introduce paid tiers with advance notice

5.4 Payment Failures

In case of payment failure:

We will attempt to charge your payment method multiple times
You will receive email notifications about failed payments
Service may be suspended after repeated failures
You are responsible for maintaining valid payment information

6. Intellectual Property Rights

6.1 Our Intellectual Property

All Platform content, features, and functionality, including but not limited to:

Software code and algorithms
AI models and training data
User interface and design
Trademarks, logos, and branding
Documentation and tutorials

These are owned by KBAILabs and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

6.2 User Content Ownership

You retain ownership of content you submit, including:

Candidate resumes and profiles
Interview responses and recordings
Company job descriptions
Evaluation criteria and preferences

6.3 License Grant to Us

By submitting content, you grant us a limited license to:

Store, process, and display your content to provide services
Create derivative analytics and insights (in aggregated, anonymized form)
Improve our AI models using aggregated data
Share your content as directed by you (e.g., sharing profiles with employers)

We will not sell your personal content to third parties or use it for purposes unrelated to providing our services.

7. Data Ownership and Usage

Company Data Rights:

You own all interview data and candidate evaluations you generate
You control who within your organization can access candidate data
You can export your data at any time
You are responsible for compliance with employment laws when using data

Candidate Data Rights:

You own your profile, interview recordings, and assessment results
You control which companies can view your data
You can request deletion of your data (subject to legal retention requirements)
You can revoke access to your profile at any time

Aggregated Analytics:

We may create aggregated, anonymized analytics from platform usage data. This aggregated data does not identify individual users and may be used for:

Improving AI models and platform features
Industry benchmarking and research
Marketing and business development
Compliance and reporting purposes

8. Termination

8.1 Termination by You

You may terminate your account at any time by:

Using the account deletion feature in settings
Contacting our support team
Cancelling your subscription (for company accounts)

Upon termination, you will lose access to the Platform and your data may be deleted per our retention policies.

8.2 Termination by Us

We may suspend or terminate your account immediately if:

You violate these Terms of Service
You engage in fraudulent or illegal activities
Your account poses security risks
You fail to pay subscription fees
We are required to do so by law

We will provide notice when possible, but may terminate without notice for serious violations.

8.3 Effect of Termination

Upon termination:

Your right to access the Platform immediately ceases
We may delete your data after a reasonable retention period
You remain liable for any outstanding payments
Provisions regarding intellectual property, warranties, and liability survive termination

9. Disclaimers and Warranties

Important Legal Notice

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability, fitness for a particular purpose, or non-infringement
Warranties regarding accuracy, reliability, or completeness of content
Warranties that the service will be uninterrupted, secure, or error-free
Warranties regarding AI assessment accuracy or hiring outcomes

WE DO NOT WARRANT THAT:

The Platform will meet your specific requirements
AI assessments will be completely accurate or bias-free
Defects will be corrected
The Platform will be compatible with all devices or software

Your use of the Platform is at your sole risk. Any content or services obtained through the Platform are accessed at your discretion and risk.

10. Limitation of Liability

Important Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GETSCREENED.IN AND KBAILABS SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Hiring decisions or employment outcomes
Unauthorized access to or alteration of your data
Actions of third parties
Any damages exceeding the amount you paid us in the 12 months prior to the claim

Some jurisdictions do not allow the exclusion or limitation of liability for consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless GetScreened.in, KBAILabs, and our officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

Your use or misuse of the Platform
Your violation of these Terms
Your violation of any third-party rights, including intellectual property rights
Your violation of applicable employment or anti-discrimination laws
Content you submit to the Platform
Hiring decisions made based on Platform data

12. Dispute Resolution

12.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@getscreened.in and attempt to resolve the dispute informally. We will work in good faith to resolve issues within 60 days.

12.2 Arbitration Agreement

If informal resolution fails, disputes will be resolved through binding arbitration rather than court litigation, except where prohibited by law. This means:

Disputes will be resolved by a neutral arbitrator
You waive your right to a jury trial
Discovery and appeal rights may be limited
Class action lawsuits are not permitted

12.3 Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles. Any arbitration will be conducted in accordance with Indian Arbitration and Conciliation Act.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

Update the "Last Updated" date
Notify you via email or platform notification
Provide at least 30 days notice for material changes
Require your acceptance for significant changes affecting your rights

Your continued use of the Platform after changes become effective constitutes acceptance of the modified Terms. If you disagree with changes, you must stop using the Platform and may terminate your account.

15. Miscellaneous Provisions

Entire Agreement: These Terms constitute the entire agreement between you and GetScreened.in regarding use of the Platform.
Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
Waiver: Failure to enforce any provision does not waive our right to enforce it later.
Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations at any time.
Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control.
No Partnership: These Terms do not create a partnership, joint venture, or agency relationship.
